MI State Police illegal search and seizure

As Michigander Tim Wagner tells us before we see visual evidence of a robbery and unlawful detainment: "It was a warm and sunny June afternoon on a Friday. I was waiting at the end of my private drive for my ride to work. At that point, I noticed a state boy (sic) pass by and so I looked at him. Moments later, I saw he was headed back my way. Then he continued until he turned onto my drive.

The YouTube video included shows what happened from that point. My Fourth Amendment rights were violated, supposedly because I was being suspicious by standing next to the road.

I felt helpless in this situation. Also, I was scared and confused…"

The shooting in your video happened at the end of 2010, the family of Douglas Zerby filed a lawsuit against the city of Long Beach and were awarded $6.5 million after a jury found the Long Beach Police Department to be responsible for Zerby's death, acting with malice and recklessness, and violating Zerby's Fourth Amendment rights. The officers also had to pay $5,000 each to Zerby's family.

Guys and gals wielding guns need to be held accountable whether they are doing it for the public good or against it.  Police departments that don't successfully police their own reckless agents out of service need to be dealt with by the public at large, since increasingly they and prosecutors do not seem to want to address accountability issues in fear of offending their peers.

This is precisely why the police are having problems with public relations. The cop was polite and doing the job he was trained and tole to do. The problem is that police have taken their "duty" to the next level and are stopping people without due cause. Yes, the man could have been a crook but then again he could have been just standing by the road as he said. It's up to the police to error on the side of citizens rights because that is what they are supposed to do, uphold the law which of course includes the Constitution. One of the most egregious cases I have heard about is in the video below. This happened in Belmont Shores, my old neighborhood of years past.  A major problem with the police is they treat a complaint that may have false or innacurate information as being Gospel. It's up to the police to determine exactly what the situation is before taking deadly force. A stray bullet out of a police weapon could have killed a bystander or someone in the adjacent buildings.
