Chuck, some members of LPD every day make a daily trip to Scottville because of the intercity police services agreement started in 2011. The sheriff's office is now able to utilize the LPD for various tasks that may require extra hands. As Aquaman has stated, fire and police department already do mutual aid between departments and already follow certain protocols when a multi-jurisdictional approach is necessary.
Deputizing effectively has the effect that the Sheriff will be dominant when the LPD and MCSO join forces for a 'big' incident, the extra liability to the county would come from actions made by the LPD when this authority is asserted. In the McAdam lawsuit, it could be said that LPD officer Warmuskerken followed the lead of the two MCSO deputies that arrived on scene, thereby removing a level of liability from the City of Ludington, who originally was one of the defendants. Personally, as a Ludington resident, I like this deputizing (primarily for such reasons), but I could see why county residents would not.
Folks living outside of Ludington are getting a darn good deal. Ludington is providing police service to them without any cost to them. I'm sure the citizens of Ludington are happy to pay for the extra police protection for all the folks who don't live in Ludington.
It's a good point of debate, as noted in this Mlive article from 2008, where the Oceana County Sheriif's Office decided to forego deputizing viillage and city police officers because of the added amount of liability (to the County) involved.
Pentwater Police Chief Mike Schuitema: "The issue of not being deputized is a moot point. There is no issue whatsoever with the county not deputizing us. On emergency response situations, we respond. We're policeman and that's what we do. Policemen take an oath to help people and assist people. That doesn't change."
Since WHEN don't combined LE officials, fire dept. officials, rescue officials, even paramedic officials, in the same or neighboring areas, not help each other and participate together in the tasks of the jobs? Since NEVER that I know of. Appears more like a "grandstand type action" plus "photo-op" to me.
