MSP Trooper Sammy Seymour avoids looking at the LPD dash cam video of his January traffic stop. A Datamaster breath analysis of Seymour indicated he was well over the 0.08 BAC for impaired driving. The six panel jury will face a day two of this trial having heard the testimony from the officer involved with the traffic stop and an officer confirming the reliability of the equipment. The panel will not be apprised of Sammy's occupation, some other field tests results, and the incidental arrest of his sister on various criminal charges at the same stop. The jury deliberated and came back with a split vote. Judge Wadel had them deliberate more and in less than an hour they came back as a hung jury. Mistrial. Time to start over.

It looks as if he is going to get off on technicalities. Judge Wadel today determined that the Datamaster reading was inadmissible as Sgt. Wietrzykowski did not observe Sammy often enough during the mandated 15 minute period before the test. Another MSP trooper testifies about proper procedure for testing.
The LPD once again is looking like a bunch of rubes and buffoons and the prosecution doesn't look like it's too deep in the game.
I hope he's going to remain sober because he'll be back in trouble if he doesn't lay off the booze.
