Here's an update on this particular case: Matt Millspaugh is going to be charged with 'moving violation causing death of another person' MCL 257.601d a misdemeanor punishable by imprisonment for not more than 1 year or a fine of not more than $2,000.00, or both.
Can Angela or anyone else give us a more detailed report/analysis of this accident? One unsubstantiated rumor has it alcohol was involved, by the auto. I don't like the sounds of that. This is definitely a double manslaughter/negligent homicide from all the facts I've been able to discover, hoping someone else can clarify and get us the truth. Thanks.
Not seeing a motorcyclist and then going over into their lane to pass another (and killing them in the process) can be looked at as at worst careless or negligent driving, which is still only a civil infraction. You must show driving in "willful or wanton disregard for the safety of persons or property" to get stiffer penalties as per MCL 257.626. I agree with all your points though, Aquaman, but until the SOS/DMV/MSP start protecting bicyclists, motorcyclists and pedestrians (BMPs) legal usage of the road and promoting their safety better, needless deaths like this will continue.
If he was left of the centerline when he hit that bike, he's supposed to be charged with negligent homicide, in this case, it would be a double homicide. A $50 ticket isn't exactly justice here if you ask me, any other bikers out there going to comment? Since when do high school coaches get this special treatment?
It's kinda sad, the LDN reports that the driver of the vehicle was Matt Millspaugh, who was recently honored just two months ago as Class D Coach of the Year for the MCE Cardinals Girl's Basketball. I believe he still teaches at MCE too. He was cited for driving left of the centerline, a civil infraction. I hope he can resolve to teach the lesson he learned from this in the future to the future drivers of America.
Maybe it's too early to tell for sure, I don't know, but the agency will probably release that in the next few days, I would hope. The public in general usually believes the heathens on bikes are at fault in most cases, every case is different imho.
That's what the earliest indications point to, Aquaman. The article indicates there were witnesses who testified as to what they saw, but the MCSO doesn't bother sharing it with the media. I think law enforcement agencies that prefers to keep public information secret when there is no harm in releasing the information, are not serving the public as they should.
Sounds like another careless driver, this time the auto, and that's a shame for the bike riders, not at fault, needless deaths again, sad. Please WATCH FOR MOTORCYCLES everyone. Thanks.
