Federal judge won't dismiss Virginia challenge to new health care law

Glad to see Virgina taking to task the issue with the requirement to purchase insurance or pay a fine. I don't personally believe the government has the power to make such a law and hopefully all the courts that end up being involved with this case agree.

A federal judge has refused to dismiss a lawsuit filed by the state of Virginia that challenges the new health care reform act, the Richmond Times-Dispatch reports.

The lawsuit was filed by Virginia Attorney General Ken Cuccinelli who challenged a provision of the health care act that requires individuals to buy health insurance or pay a penalty.

"While this case raises a host of complex constitutional issues, all seem to distill to the single question of whether or not Congress has the power to regulate -- and tax -- a citizen's decision not to participate in interstate commerce," wrote U.S. District Judge Henry Hudson in his 32-page ruling, the Times-Dispatch reports.

He said the case cannot be resolved without a further hearing.

Missouri has a ballot measure to invalidate this requirement tomorrow. Four states (Idaho, Georgia, Louisiana, and Virginia) have also passed measures in their legislatures for this aspect. Now that the law has passed, the hidden 'taxes' behind it are becoming obvious to everyone.

I think it would be a good thing if the people in the states would pass an amendment to the Constitution that would clarify an American's right to choose his own health care options. I know a 'wacko' or two that happily use alternative medical care and are deadset against current medical orthodoxy and standard practices. Why force them into something they wouldn't ever use and are so vehemently against?
The Missouri proposal passed 71 to 29 percent in a stunning rebuke to Obamacare. You gotta wonder if they are listening yet.
They are not listening... As Joy bahar is it?? on The View?/ stated to Barrack the Republicans are "steeling the narrative". I had to laugh as she has bought into all the bull the facts are the more even people who voted for Obama see and read about the legislation passed the less they like or want it.... But the liberals just do not get it or even care. The means justify the ends to them.
