Police Recording Has William Marble Shot Before Ordered to Drop Any Weapon

Nancy Marble, His Distraught Wife, Led Out of Her Own House in Handcuffs

 

Late on January 14, 2014, a former Mason County Eastern teacher, a community involved, beloved man who spent over 35 years of his life teaching kids in the Custer area, was shot in the chest by a state trooper and summarily died.  The original news reports, which did not surface until about 10 hours later, were sometimes conflicting of what happened, here is the original Torch article on original shooting

 

After these initial reports, which included neighbors and professionals he worked with telling us what a friendly person he had been throughout his career, the public waited for some official word from the Michigan State Police, who were investigating the case concerning their own state trooper, whose name was withheld until the Prosecutor's report came out over three weeks later, which found the trooper's killing of Bill Marble justified.  Still FOIA requests were ignored to get information to the public, this article details how the MSP obstructed letting the public see the evidence. 

 

Now, thanks to the MSP taking over a month and the threat of more lawsuits against them, the Ludington Torch has exclusive video and audio of that night's events after spending over $100 for it. 

 

It shows that the official report is a bit off base, it shows that Bill Marble was shot before he was ever engaged in conversation or told to drop a weapon, it shows that Nancy Marble was led out of the area in duress and in handcuffs after seeing the horror of her husband getting shot,  it shows that Bill Marble was denied prompt medical attention.  It shows the trooper's callous disregard for Bill Marble's fate or Nancy Marble's feelings.

 

The prosecutor of our county, says this activity is justified, do you?  He surely did not feel that way when a trooper was fatally shot in our area unjustly.  Look at the video, check out the stills and commentary, and decide for yourself.

 

 

At 12:40 in, Trooper James Luttrull arrives in the driveway and gets out after driving full code (lights and siren) from east of Scottville.  For the nature of that call (woman with phone problems), it seems odd that protocol would have him drive that way in such bad conditions.

 

 

 

At 20:05 Hammerle arrives.  If the video timeline is unedited, as it seems to be, then unlike the official report from the prosecutor, which says Luttrull overheard 27 minutes of arguments, is greatly in error, as there was only about eight minutes. 

 

 

Shortly after this, at about 21:00, everything develops.  Listen closely to what sequence of events happen.  A gun shot rings out at 21:07 before any trooper says "drop" or anything else.  Trooper Luttrull, aware of his microphone (he references it at the 35:25 mark, and the 45:30 mark in the recording) continues to tell Bill Marble to drop his gun even after it has allegedly been shot out of his hand.  Nancy screaming and repeating the words, "Oh my God", finally tells Bill at 21:51 to "lay down", then runs away.  The reports make it seem like she was telling him this immediately.

 

But the reports also say that they said drop twice before any shots were fired, and I don't hear it.  I also don't understand how they could take off their holster strap, draw their weapon, take off the safety, and shoot Bill Marble when he had the drop on them at point blank range down a clear hallway, vacated by Nancy, according to the official report. 

 

At 28:06 Hammerle walks back out, leaving Luttrull alone with the Marbles, Nancy is behind a locked door. 

 

At 28:55, Hammerle heads back up, soon to be followed.

 

 

 

At 29:19 Two MCSO deputies arrive, they try to help coax Nancy Marble out of the bedroom after checking in.

 

 

Deputies begin to talk Nancy out of the bedroom, she admits to be very afraid (starting at 34:00 in).  At 37:40, someone sounding like Luttrull says:  "Bill, you're doing fine, Buddy."

At 39:44, a MCSO deputy comes out of the house.

 

 

 

At 41:16, after no struggle and admitting to being very afraid at the situation, and after having committed no offense, unless hiding from the people who just shot your husband without a clear reason is a crime, Nancy is led out of the house in handcuffs.  Although we can hear the interchanges with Nancy throughout, nobody informs her why she is being taken into custody and marched out of her house.  Through the official report, we learn she was taken for interrogation down to the MCSO.

 

Even if we are to give the police the benefit of the doubt for lying in their official report about the shooting incident which killed Bill Marble, this is at least as big of an indignity.  Nancy has just seen her husband get shot, had deputies tell her that she would be safe if she came out of the bedroom with her hands up, and then is summarily handcuffed and led out of her own house, against her own volition, while the police are free to adapt her house to their reports.

 

 

 

At about 50:00 the microphone is away from the house, and away from Luttrull, probably placed back in his vehicle.  We hear radio traffic occasionally.  By the end of the one and a half hour video, William Marble is still as close to the hospital as he was when the video started.  Killed in his own home shortly before midnight on a cold January morning without any warning by a trooper that can unstrap, unholster, unsafety, and shoot a gun quicker than he can say "drop".

Every time a shooting like this gets labelled "justified", it encourages trigger-happiness over the actual mitigation of an incident through non-violence for police officers.  Trooper Luttrull is likely a hero among his fellow troopers for making sure he was able to come home that night. 

As you can tell from the way he goes up Decker Rd., he couldn't figure out how to get to the corner of Decker and Hansen, and likely had no knowledge of what kind of people lived at the Marble house.  It's why it might be time to limit the Michigan State Police presence in Mason County.  They have shown themselves to be 'sloppy' at this encounter and the Butterfield traffic stop (no in-car video, no stated reason for the stop). 

If Butterfield knew the history of Eric Knysz, he may have been more 'vigilant' as he approached.  If Luttrull knew the history of Bill Marble he may have been less apt to shoot so quickly.  He was entering the man's domicile at midnight uninvited, after all; one should expect suspicion when their coat is covered with snow.

So why did the officer run  out of mr marbles house carrying  a rifle in such a BIG hurry, & I herd a shot go off &  after that the officer tells mister marble to drop, & mrs marble saying Oh my god, help him, & she was screaming something awful, I feel sorry for that family, Mr. Marble was a great teacher he teached my son, & my son's friends, and my family has had him as a teacher , they all loved him, & he would never hurt anyone one, if anything he would give you the shirt off his back. Also why did the officer go around the back of the house & not the front door?  and I heard Mrs. Marble sounding scared when the officer just  , what sounded like he walked right into their house w/o any warning, He never knocked, That should not be aloud . The officer was lisening into their private confersation &  just open the door and walked in, and why is Mrs. Marble hand cuffed she never did anything, and why did'nt anybody call 911 after Mr. marble was shot, like Mrs. Marble asked? & what was them 4 officers doing in their house all that time, What happen to that rifle the 2 officers brought outside in such a BIG hurry ? I hope the doggy is begin taking care of & Mrs. Marble is doing ok that lady has went thur alot my prayers are with her

Hey we thought of another thing their is a spot where that 1 officer came in from the side &  if you notice he was running around to not be seen by that camera & their was NOT 2 officers in that house when Mr. Marble was shot their was only 1 officer Mr. Luttrull, &  why is it the prosecutor is saying Mr. Marble had a pistol, when the officer comes running out with a rifle, and also when in the video the officer said " I"  was standing here for a while lisening to you to argue and the prosecutor's report said their was "2" officers their after the shooting, and their was not ,the 1 was their & the shot was done & after the fact the other officers show up

The view of the police car shows only the traffic that goes to the back door, which is the primary ingress, but I think there may have been eventually officers going to the front door.  It does sound as if Nancy saw just one when she said "There is a copper at the door." at 20:38, and the one talking is obviously Luttrull.   

I never saw that rifle going up that way, but the guy is definitely running with it later into the encounter.  These two photos show that more could have come from the front, but probably not from the other side of the house to the back door.  These photos are from Mlive, taken early the next day.

You're right, she said there was a gun pointed at the door, never any mention of a policeman.  I thought she had said 'copper' but it is 'gun pointed'!  That is really messed up!  Why did they come into the situation like that!  Bill Marble did not have any idea there was a cop at the door, might not even have ever known that a cop shot him.  Trooper James Luttrull executed William Marble.

Protocol didn't seem to be followed, the MSP wants to sell me their policy for checking on 9-1-1 hang-up calls for about $50.  Without any idea of what I am paying for.  The MSP is corrupt and unaccountable.

I added another video on the thread head which tracks the 9-1-1 traffic early on in this call, including the phone calls of Nancy Marble.  The space between traffic has been taken out.

She's busy lobbying for Ludington State Park to be renamed Luttrull State Trooper Park.

I am betting that Spaniola devoted very little time to his opinion on this, considering that beyond his normal workload, he was preparing for the two big time trials (Eric Knysz, and Sean Phillips-open murder) where he gets to play offense.  I wouldn't be surprised if this was effectively ghost-wrote for him by the MSP, because I have seen some of his own product, and that he signed off on it after he perused it. 

Hey, if the MSP does the shooting, does the investigation, isn't it only fair that they create the opinion?

I'm continuing to dig into more of this, because only the people that did this and approved of it can answer your very good questions.  I encourage readers to demand these answers.

 

Well we all, I'am sure want answers just like Mrs. Marble she will want answer's to , it is wrong, If they keep getting away with this & nothing is done to them, for their actions then they WILL keep doing it over, & over  & over again, why should they be aloud to get away with killing someone, lieing, coerions, and all the other stuff they get away with , Police officers should be getting the same jail/prison  time as anybody else gets when they do things wrong, You don't reward a killer by nameing a state park after them? Its like the officers are trying to run the areas, they don't pertact us, like they are suppose to do , They seem to be hurting us & are loved ones.

This is what happens when we have a non responsive press who does not ask questions or does not do a complete job of journalistic investigating but only takes the word and opinion of those Governmental institutions as gospel so they can avoid rocking the boat. Another reason why LDN is not worth the ink on their news pages.
