Man receives $128 ticket for warming up car in his own driveway

ROSEVILLE, Mich. — A Michigan man is furious after he was ticketed $128 for warming up his car in his own driveway.

On Jan. 2nd, Nick Taylor started his car to warm it up before going inside for five minutes, Click on Detroit reports. When he went outside to check the vehicle, he discovered a ticket that read, “vehicle parked in drive with keys in ignition, motor running — no one around.”

Roseville Police Chief James Berlin says leaving the key in your vehicle while it is unattended is “a public safety issue.” If you use a remote starter and the key isn’t in the car, it is OK.

On Thursday, an angry Taylor took to Facebook about the incident.

“Let’s all take a moment to thank officer dip**** K. Keary for wasting the taxpayer’s money and giving me a ticket for warming up my car in my own driveway,” the post read.

“Unattended car?” Taylor said. “I’ve done this every day for seven years. Every person warms up their car. We live in Michigan.”

Hundreds of people replied to the post, many wondering why this is something police would ticket.

One post read, “This is so unnecessary” while another simply asked “why.”

The photo has more than 13,000 shares, 4,900 comments and 4,600 likes.

this is totally crazy, just another cop trying to find another way to make more "Brownie Points" it must be a rase to see how many can get the most points, on their gas card i guess. You know them ones that you get freebies for points . lol

Sadly, the police have the power to do this.  The Uniform Traffic Code (UTC) including Rule 458 reproduced above, has been adopted by most cities, townships and villages by reference, meaning you have to follow it in those places, like the cities of Ludington and Roseville.  Few police would actually enforce this when you are warming your car in your driveway, they will be effectively breaking what many would consider a more serious law of trespassing by doing so. 

Even if lawful, police should be called to the mat for doing this as it is very silly to enforce this law during the wintertime in Michigan, when technology exists specifically to warm your car remotely, and make you an automatic violator of this rule.

Something that is unsettled for me, If I can not afford remote start I can be ticketed? Its all about the key in the car! Very odd laws we have that need to be re thought now with the HUGE influx of technology and the internet! This is not the 80's, or even 90's! Too many getting in trouble now innocently, we don't know how to act it seems, a written word can be taken many ways, need more coursework/heads up in schools!

That letter for RSoundz is definitely self serving. My guess is that an extremely small percentage of vehicles stolen are those that are being warmed up in frigid weather. Most cars can easily be jimmied and stolen. Professional car thieves keep up with technology and are not fooled for long when some new device is installed on modern vehicles.

This story is getting more press in a day than Rob Alway has received his whole career,lol. Every Tom Dick and Harry are jumping in on this one. Nick has not only had offers for a free remote but also someone is helping him with legal,lol. The town is flooding social media with some really disgusting facts about the Chief , his comments, animal abuse and, his retirement plus salary income. Nick works at Best Buy so wonder how that will play out.

Ludington Police leave patrol vehicles running for hours with A/C cranked on High at the beach all the time and they sometimes are hundreds of feet away. Never looked in to see if they had keys in the ignition. Waste of money and puts a lot of stress on engine and electrical components which become costly repairs. Not to mention killing our planet unnecessarily. Catalytic converters can cause fires from excessive idle.
