Manistee Judicial Candidate Helps Grow the Homeless Without Any Explanation

 The headlines of the Manistee News Advocate calls it as it is, a "RUDE AWAKENING".  On September 8th, the approximately ten homeowners of the Eastlake Estates, a mobile home park on Eastlake Road in Eastlake, received eviction notices in the morning mail.  The Eastlake Estates have been owned by Tiburon Ventures LLC operating out of Troy, Michigan since 2010.  The eviction notices call this a 'just cause' eviction which means that the owners must either change the basic usage of the property, or condemnation of it.

The mobile home park has room for up to 50 units, but according to the current residents, that number is low because of the lack of any manager, unscrupulous tactics of the past, unkept promises, and little or poor services that the company was supposed to offer by contract.  Here is the article in full:

On the page 5 continuation, we find that Ludington's main City Attorney, Richard Wilson of Manistee law firm Gockerman, Wilson, Saylor & Hesslin PC. doing what he does best, declining comment on why the eviction was being done.   The article continues by airing the observations and complaints of the residents of that mobile home park, illustrating a history of negligence and abandonment by the managing company.  The company and its attorneys, including Wilson and George V. Saylor, candidate for the 19th Circuit Court serving Manistee and Benzie Counties decline to comment as to the reason these people are getting thrown off their lots, even nearly two weeks after the notices are sent: 

One may wonder why a candidate for judicial office would permit such a public relations fiasco to occur right in the middle of his running for office.  It could be different if the managing company of Tiburon Ventures LLC was not what appears to be a deadbeat landlord/manager and if they had a definite reason for their mass eviction announced to their tenants.  But barring any counter-evidence, they appear to be as shady as the attorneys representing them who decline to comment on the reasons why. 

For the legality of termination tenancies in mobile home parks are found in this chapter of Michigan law and this section (MCL 5775) says (section 1): " The tenancy of a tenant in a mobile home park shall not be terminated unless there is just cause for the termination."

It then defines 'just cause' as one or more of several instances, only a couple of which are appropriate irregardless of what the tenant does, as the article mentions:  condemnation of the park, or changes in the usage of the park.  Both require action that would need to be done by the local City of Eastlake government agencies or the county government agencies (i.e. Planning, Zoning, Assessing, Housing etc. agencies) .  Since there doesn't appear to be any condemning going on by an official agency, and no record of the local planners agreeing to a change of use, one can presume there is in actuality no "just cause" to remove these old and disabled tenants from their homes with one month notice.

19th Circuit Court Judge candidate George Saylor has it right when he says "Justice Delayed is Justice Denied", and yet his partner and himself are trying to throw ten families out of their lawful homes without any sort of "JUST CAUSE" applicable.   I hope these ten families remember this when they awaken on November 4th from their tents and homeless shelters to cast their votes for Saylor's opponent, David Thompson.  Hopefully, other voters will awaken that same day to vote against injustice once they make the connection of just how unfair Saylor and his law firm are.

Even if those folks had the money to move it's going to be difficult to find a place to put their trailers and if they do find a mobile home park with vacancies, most parks will not allow older trailers to move in. Most people don't realize what they are in for when they buy a mobile home. You really can't fault the owners of the park for wanting to get more money out of their land investment but that's no excuse for putting their tenants in a bind.  There should be better language in the existing laws that protect owners of mobile homes who are renting lot spaces so folks won't be stuck with a trailer they cannot find a home for.

Quite right Willy. Thanks for the heads-up X, good thread. A good local attorney with the ability to help without fees, would be advised. Someone that has the real estate expertise and would work pro-bono. I would advise asking candidate Thompson for a start, or someone he can recommend, and also send a return letter to the Detroit big-city boys, asking what they are referring to as "just cause". It's hard to imagine that CA WIlson has a hush order as his answer too. I thought that man had an answer for any question, appears this time he has NOT done his required Homework! The Manistee News Advocate seems to have a big leg up on the local fixed LDN, good work to publish with real journalists. 

Yesterday was the day when the evacuation of the last dozen occupants of the East Lake Estates mobile home park was to be completed, no word yet on whether this was achieved.  Hopefully, we will see an update in the Manistee paper on Monday.  As of yet, other than the Torch article and the Manistee paper there has been absolutely nothing I can find on the web regarding this 'just cause' eviction and nothing has filtered in yet about what this 'just cause' ever was. 

The owners or their attorneys should be able to convey what that reason is, if not to the media, at least to the people that have been affected.
