The Oceana County Assistant Prosecutor states "...remaining on property after being told by the owner or agent of the owner to leave said property, without having their own legal right to be on the property, is trespassing. It is a misdemeanor punishable by fines up to $250 and up to 30 days in jail.”

Remember this when your in-laws overstay their welcome or especially the next time the police (or any other pesky government official) come to your property without a warrant/court order and you ask them to leave.  If this happens to you, make sure your local prosecutor goes after them with the same vigor they're going after these vacuum cleaner salespeople. 

Overall, this is a good thing for those who believe in the sanctity of property rights, not so good for those who want to sell things door to door.

HART — Two Grand Rapids residents have been charged with criminal trespassing in connection with recent complaints of aggressive vacuum salespeople in the area.

Darnell Marquis Burton and Brenda Spicuzza have been arraigned on charges of criminal trespassing in 78th District Court, said Oceana County Chief Assistant Prosecutor Erin Fisher.

Authorities investigated similar complaints of aggressive vacuum salespeople in the Mason County area last March.

Burton and Spicuzza are allegedly “the Kirby vacuum salespeople that have been barging into homes and using high pressure sales tactics on residents of Oceana County,” Fisher said. “I have charged each of them with criminal trespassing. Criminal trespass under MCL 750.552 states that remaining on property after being told by the owner or agent of the owner to leave said property, without having their own legal right to be on the property, is trespassing. It is a misdemeanor punishable by fines up to $250 and up to 30 days in jail.”

There are more salespeople allegedly committing similar crimes, the prosecutor said. “These individuals are reportedly still in the area,” Fisher said. “Residents should know who is at the door before even opening the door, as these individuals will barge in and refuse to leave, sometimes for over three hours. I would like to keep awareness of this situation in the area going in order to keep residents of our community safe and discourage these salesmen from continuing these intrusive practices in Oceana County.

“I will not hesitate to charge any others who fit the elements of the crime by engaging in similar behavior,” the prosecutor added.

If you think vacuum cleaner salesmen are annoying, see how extra annoying they are when talking in German:

Either these sales people are desporit or just extemely overbearing.  My understanding is that if a person "barges" into your home uninvited that is considered home invasion, so why aren't they being prosecuted for that?

Home invasion additionally requires the "intent to commit a felony, larceny, or assault in the dwelling" or the actual commission of the same as elements (MCL 750.110a ).  I knew a person who did Kirby sales for a little while, and they were trained to turn around soft refusals so as to get demonstrations and sales; it resembled soft trespassing. 

More problems for Kirby vacuum sales people.  A Kent County Kirby man steals money and a gift card from an 81 year old lady, gets nabbed when he uses the gift card and gets caught on video.

I missed this earlier. This last deal is real offensive and should get that guy 4 years. What's next nowadays? 

I wonder how may others he has stolen from. He probably makes his living by stealing and the vac. sales are his sideline. Kirbly is surely not watching their sales staff and had  better start paying attention or they may end up losing everything to a law suit or people refusing to buy their products because they won't let sales people in their homes. Reputation is everything.
