Illegal Alien Hit and Run Driver and Serial Liar Court Clerk Wife Given Free Pass

The Mason County Press did another turn on the investigative front by relating the story of a local court clerk and her husband, how she dutifully tried to protect him from legal jeopardy by admitting to a crime she never committed, how her duplicity was caught, and of how they both escaped any real consequences despite their lies and evasions.

Rob Alway of the MCP waded through dubious court records and a credible police report to find that this couple received preferential treatment by the local justice system, this follow-up will simply present his article in full, assume that what he printed was accurate, and analyze further the great deal this pair received and why you are not likely to get the same treatment when you do the same and don't have the clerks at the 79th District Court working for your defense.

"LUDINGTON — An employee of the 79th District Court recently pleaded guilty in that court to the misdemeanor of providing false information to a police officer. The employee, Rosemary Saucedo- Narvaez, 52, of Ludington, continues to be employed by the court as a clerk.
The charges stem from a Jan. 7, 2019 vehicle crash that occurred about 6 a.m. at the intersection of Ludington and Washington avenues. Saucedo- Narvaez’s husband, Alfonso Narvaez, 41, was driving a vehicle eastbound on Ludington Avenue when he struck a vehicle traveling northbound on Washington Avenue. According to a report from the Ludington Police Department, the northbound vehicle drove through the red light and Narvaez had the right-of-way. However, Narvaez did not stop following the crash and left the scene.
The impact caused the northbound vehicle, driven by Cory Robert Hernandez, 41, to “spin around” and disabling the vehicle. On the scene, Hernandez told police officers that the lights were blinking and that his vehicle slipped on the ice causing it to not stop. Hernandez said he pulled his vehicle to the side of the street on Washington Avenue and a witness called 911. Hernandez was cited for not having proof of insurance and was given a warning for failing to yield the right-of-way.
A few hours later, Rosemary Saucedo- Narvaez came into the Ludington Police Department station and asked to speak to an officer. She told Officer Jacob Miller that she was driving the vehicle and that her insurance agent had told her that she did not need to stop at the scene of an accident, according to her statement in the police report.
“I informed Rosemary that if she is in an accident she needs to stop and make sure there are no injuries,” Miller stated in his report. “Rosemary apologized and said that she had been told otherwise.”
On Jan. 9, Officer Miller asked Saucedo- Narvaez to come in for an additional interview. During the interview, Saucedo- Narvaez told Miller that she was driving her husband to work, in southern Pere Marquette Township. During this interview, she told Miller that she did not stop because she looked back and “saw that the other vehicle left the scene.” She then stated that she continued down the road and took her husband to work, again confirming that she was driving.
“After speaking with Rosemary about her story, I informed her that I believed she was being deceptive,” Miller stated in the police report. “I informed Rosemary that parts of her story did not match my investigation. I requested that Rosemary inform me of what actually happened the morning of the crash. Rosemary began crying and informed me that she was not driving the truck. Rosemary stated that her husband was driving the vehicle and was in the vehicle alone. Rosemary stated she was at home when the accident occurred.”
Miller continued in his report, “She stated that soon after the accident Alfonso Narvaez called her and she told him that she would pick up his truck (from work) and drive it to the Ludington Police Department, take the blame for the accident… Rosemary stated that Alfonso is an undocumented immigrant and he is not ‘legal’. She said that he does not have a driver’s license either. She stated that she is afraid that Immigration and Customs Enforcement will deport Alfonso if he gets in any trouble. Rosemary stated that she cannot care for her grandchildren and pay for the house without Alfonso’s income. She stated that if Alfonso is deported she will become homeless.”
Miller said he then asked Saucedo-Narvaez if her husband was willing to come to the department and speak to him. She informed Miller that her husband struggles with speaking English and may need a translator. Miller arranged for a police officer from Hart Police Department to come to Ludington to translate. When Narvaez showed up, Miller said Narvaez spoke English well enough to not require the translator. During the interview Narvaez confirmed that he had been driving the vehicle and left the scene.
“He stated that he knew leaving the scene of an accident was illegal but he left because he was afraid of getting deported.”
A warrant was requested by LPD for Rosemary Saucedo-Narvaez for filing a false police report and to Narvaez for leaving the scene of an accident.
Saucedo- Narvaez was found guilty for filing a false police report/or statement to police, on Jan. 28 and sentenced to $275 in fines and fees. Typically, filing a false police report is a misdemeanor punishable by up to 93 days in jail and/or a $500 fine. However, Saucedo-Narvaez information on Saucedo-Narvaez’s arraignment was not furnished to MCP, as is standard practice by the court. The signature of the judgement of sentence is of Lake County Magistrate Gregory Block.
Charges against Narvaez were dismissed. According to court documents, he was listed under the name Francisco Sanchez and had been arraigned for one count of operating with a forged/altered/false license was dismissed Jan. 11 (the arraignment information had not been provided to MCP, which is normal practice by the courts). A note on his court record states: “Defendant has presented proof that his real name is Alfonso Narvaez. Therefore, People cannot prove he made a false statement to law enforcement. Defendant has pleaded to the underlying charge,” his court file states.
The crash was not Narvaez’s first. On Dec. 7, 2017, he pleaded guilty in 79th District Court for failure to display a valid driver’s license and was sentenced to one day in jail with credit for one day served, and $275 in fines/costs. His conviction was reportable to the Michigan Secretary of State office.
Saucedo-Narvaez remains employed by the district court, an employee of the county. The County of Mason employee handbook, under Section 210: Background Checks, part H, states that employment may be suspended and/or terminated if the employee is convicted of a felony involving sexual misconduct or an act of violence, which neither were the case involving Saucedo-Narvaez. However, section H also states “All other convictions types will be reviewed for job relatedness and also reviewed by a labor attorney if necessary.”
A request to the county administrator about whether Saucedo-Narvaez will remain employed by the county has not been answered as of posting. " [END Article]

ANALYSIS: There is a lot of information here, and not all of it makes sense if you believe our local law is blind and treats everybody the same way. If you were that naïve before, I hope your eyes will open more fully once you consider the facts in this case.

Let's consider what happened. The investigation's findings put Alfonso behind the wheel in an accident that doesn't appear to be his fault. He knew that it was illegal not to stop at the scene of an accident, yet he didn't bother doing so since he was somewhat concerned about his immigration status. He drove on to work, called his wife, and they hatched a scheme whereas she would drive to his work (which appears to be Pallets Recycle Inc.) pick up the truck involved in the accident, drive that back to the LPD and claim that it was her who was driving.

Furthermore, she would shockingly claim that she did not know the law about stopping at the scene of an accident, when she works for a court that processes such violations regularly and should know the law inside and out. To bolster that claim she invents an insurance agent she supposedly called at 6 AM who told her it was okay to drive away from an accident, advice no insurance agent would give as they know the law as good as a district court clerk if not better.

Two days later, when confronted with contrary facts to her statement, she admits that she was driving her husband to work and claims she looked back and saw the other driver leave the scene. Challenged more, she breaks and admits her husband is an illegal immigrant, that he has no driver's license (and likely not insured to use the truck) and that she was not in the truck at all. She feared that ICE would pick him up, deport him, and that she would lose everything. Alfonso verifies that story and fear at his interview. Here is what they received and what is normally doled out.

Rosemary received a nominal fine of $275 for willfully lying to the police on two different occasions. Two recent news stories in Michigan had misdemeanor counts for lying to a police officer. A Washtenaw County probation officer pleaded guilty Friday, Dec. 14 to two counts of lying to a peace officer - one a felony and the other a newly-added misdemeanor... The misdemeanor charge is punishable by up to one year in prison and a $2,500 fine. Former Michigan State University women's gymnastics coach Kathie Klages has been charged with two counts of lying to a peace officer... The charges include a felony and a misdemeanor - the felony charge is punishable by up to four years in prison and up to $5,000 in fines, and the misdemeanor charge is punishable by up to two years in prison and up to $5,000 in fines.

She was 'tried' apparently by Lake County Magistrate Gregory Block, which is part of the 79th District Court she works at, this is rather unethical and reflects badly on the court as it is an appearance of impropriety that they would 'try' her in the court she clerks at. Worse, court magistrates, unelected court officers of the district courts in Michigan, have limited powers in the court system. About the only thing they can consider in the Michigan penal code is trespassing violations, not a potentially serious crime like lying to the police which can be a felony.

As this action was seemingly done without knowledge by the Honorable Judge Peter Wadel who would have the initial jurisdiction, one would have to believe it was set up by her office-mates in the district court, and any kind of arraignment was waived, as inferred in the article by its absence. Another question that needs to be considered: was there an actual prosecutor assigned to represent the state's interest in seeing that its laws are equally enforced? There doesn't appear to be according to the MCP.

The biggest injustice, however, is that nothing happened with Alfonso Narvaez because the only thing he was ever charged with by an unnamed prosecutor was making a false statement to law enforcement, but that admittedly never happened. The warrant for Alfonso was for leaving the scene of an accident, which was never considered by the prosecution or the district court. In fact, beyond his illegal alien status Alfonso is guilty of quite a bit of things which never got before the court, unlike it would for you and I. Including:

Driving without a license (2nd offense)- misdemeanor (year in jail and a fine of $1,000. In addition, the truck could be immobilized for 180 days).
Leaving the Scene of an Accident- misdemeanor, felony if serious injury occurs
Lying to Police (getting someone else to lie on your behalf is equivalent)-misdemeanor, 1 year or $2500 fine for each count

None of these ever came before the court, not even a false trial in front of a magistrate like she got, and yet you see these charges come before the same court Rosemary Saucedo clerks at all of the time, with stiff fines, serious prosecutions, and sentences meted out to those not so fortunate of having someone on the court lie repeatedly to the police and influence the normal court processes, so that the man she loves doesn't have to pay for his crimes. Nor does she pay for her own crimes and lapses of ethical behavior, as she makes the court she works for a mockery for those who expect fairness and justice.

Let's not forget he is here illegally and that is a crime. I for one am sick and tired of coddling the illegals in this country. The full weight of the law should be applied in this case if only to make an example of how the our legal institutions are bending over backwards to protect illegal aliens. There should be a State Attorney investigation into the 79th District Court which has forever tarnished it's reputation for not upholding the laws and Constitution. There appears to be massive corruption permeating the 79th Court. All involved with this corruption should be fired and prosecuted. To me this is a major case of fraud. What other cover ups has the courts been involved with? I have to give credit to Alway for reporting this story and thanks to X for analyzing it.

 The only thing that a person would believe good about this is the illegal immigrant has a job. That said ,he's here illegally and thus taking a American citizens job. You have to wonder whats up with our MASON COUNTY court system to allow a person that has no drivers license , smash into a vehicle , leave the scene of the accident and just get off scot free?   What do we have a bunch of Democrats working up there? Free boarders for everyone.  The illegals have reached their promise land. One foot step into the USA and they are eligible for free food, housing and medical care. And that is just a start. It was on the TV news a couple of weeks ago that 300+ crossed over or under a old fence and just lined up for the Boarder Patrol to be taken into custody . No sneaking in anymore, if they do sneak in they get no freebies and they know that. $100+ billion spent annually on illegals each year and that information from the Department Of Justice is before the influx of the so-called caravans of immigrants came in. Also the anchor babies , $4  + billion annually and that is information months old also . Now we have more women than ever crossing into our country. Who is going to pay when everybody wants to ride?  It has been said that after 20 days the illegals are let go . They should all be loaded up on buses and dropped off at Nancy Pelosi"s house.Let her support them . She's worth $50 million bucks. Wonder how she got rich when she never had a real job?

So, what's up with this coming to MCP News almost a month later on 2/4/19? Does Mayor Miller support this obvious "sanctuary city" type of actions? How about Knizacky for Mason County? How about LPD for no report and hold for ICE? How about Court dismissing the charges? No conflict of interest anywhere? Collusion and improper lack of legal actions are all over this. This particular case shows just how warped our own small local town is today, never would have guessed any of this could actually happen here at all, yet, all the facts and proofs are here now. There needs to be some leaks to State of Michigan, Federal ICE authorities, and anywhere else as necessary. Some fishy people need to answer to all this asap, along with either firings or resignations of those whom participated in all this imho.

There is a toll-free number or email where known illegals can be reported and if the crime is great enough, there could be a reward. Like the illegal activity going on at the Hispanic meat market in Shelby a few years ago for illegal barter of food stamps nearing $1,000,000 of taxpayer money. Some honest taxpayer finally got tired of seeing it. The perps may still be serving time in federal prison in Grand Rapids. It's a shame that the illegals know how to get assistance and abuse it. Sometimes they act like they don't understand English. This guy should be prosecuted and his "wife" to stop it in its tracks. There could be bigger crimes involved working under a fake name.

Fairness and Justice are ideals and don't exist in the our present system.

Knowing this information may help the average citizen so they are not surprised when they learn that a court clerk has not been held accountable for breaking the law.  

How is the driver an illegal if he is married to a citizen of the US?  Once married, they become a citizen.  Are they actually married? 

If the man is repeatedly driving a vehicle without insurance and a drivers license and it is not causing any major issues with the Ludington Police Department, let this serve as an example to other citizens of Ludington and save your precious time and money and go without the DL and insurance.   Appoint yourself the tax free loan authority in your city and begin issuing school loans with tax payers dollars as well after all, it appears to be working.

Why would a person with little to nothing to take purchase insurance in the first place?   In the State of Michigan and person can kill another human being with their vehicle, not have insurance, and there will be no additional consequences for not having insurance.  They pay no fines nor is there any additional jail time added for not having insurance.  Information the "average" citizen could benefit from knowing.

Perhaps the real problem actually exists with "average citizens" (those who are unconnected to the system) who still believe there is a just system and the don't yet know that the law only applies those outside of the legal/criminal system. Perhaps holding clinics on how to be as corrupt as the system need to be held on an ongoing basis so the average citizen will no longer be so ignorant.  Clearly educating the "system" will get us no where because they have already figured out how to beat it and not be held accountable as evidence this particular case and so many more presented here on the Ludington Torch.   Ignorance can be bliss until you are no longer ignorant. 

  If an illegal immigrant marries a US citizen they become a relative status. They still have to get a green card. That can be easy or difficult depending how they came into the country. If they crossed the border illegally they have to go back to their country of origin and apply. Multi year wait to come back and no guaranty they will be let back in because they broke the law in the first place.  Lots to read on the subject of citizens marrying illegals . Being this guy is undocumented , chances are he came in illegally, committed crimes in our community and our police do nothing that we know of is just inexcusable . Somebody should call ICE and have him deported , let him wait in line to return. As for his wife? is she legal?  she made a couple of bad choices , she is working in a county government building . Not to good  ethics handling our business.

That is what I was wondering, Stump.  How is it her "husband" is illegal?  Did she marry an illegal?  That doesnt say much for her ethics.  Why didn't a background check in employment check that?  Who else in her family is illegal and what crimes may they be committing?   This does not look good and illegals push the U.S. systems laughing all the way to the bank with free handouts, foodstamps, healthcare and benefits, and often sent money they make in the U.S. back to family in Mexico.

Pallet Recycle has long been known for bringing in and hiring illegal aliens, over 30 years. So, that in itself is no surprise. I also question how in the heck did he only get a sentence of one day in jail? I never ever heard of that on any case, even a traffic misdemeanor, should have been about 60-90 days for all he did illegally. She too should have had 15-30 days imho. They both got off scott-free, and we are paying their judges and employees to do this, very sad.

These articles have rattled a few cages. There are almost 1100 views here, 2700 on Rosemary's Babies and 800 in one day on Rosemary Extract. MCP Facebook has 140 comments, and about 138 agreeing this is wrong. This is just one little example in one little town of similar and bigger problems with illegal immigrants across the nation. Will a wall solve it? Who knows? I've been across the Mexican border many times. The free movement into the U.S. from Mexico does little to require Mexicans to return to Mexico. Once the illegals reach safe neighborhoods in El Paso, Brownsville, or San Diego, for example, they migrate from there with freedom. I think enforcement should then take place at the city and state level when found undocumented. The problem is, we cannot take care of all of Latin America inside our borders. Free hospitals for births, health care, free schools, free legal representation, food stamps with fake documents and on and on.

Those that go through legal immigration, have a job and pay taxes are welcomed. That's how America was established. Anyone who came through Ellis island had to have a sponsor who promised aide, and the immigrant had to prove skills or a job.

   Apparently our local police hasn't heard of the federal government laws on Secure communities.      On another note: The wife of the illegal undocumented immigrant .  Did anyone even check to see if she is married to this guy?   Seems she's good at telling stories  If Ice is called in they should stop at Pallet Recycle to get a bus load to go back to Mexico.

Well stump, they've done that at Pallet Recycle many times previously, and almost all got deported/jailed. How is it legal for an out of county Magistrate to make court rulings like a judge? I thought only visiting judges could take the place of another judge, that's not right. Why was Wadel absent again? He's also been missing on other similar cases. And isn't it perjury to lie to the LPD? When they ask for sworn statements for cases, they ask you to swear the truth usually. Didn't in this special case? Wth is up with all this stuff? The more I know and read, hopefully with new evidence being released, the more upset I get with the whole damn thing.

Was reported last nite on Fox, about people making up reports of lies to Police: if found to be a lie, your story about a crime, you are guilty of a 4th degree Felony. Punishment for being prosecuted is 5-10 years in jail, plus a high fine. That certainly applies here to Rosemary imho, but I bet it just gets ignored anyhow.
